Welcome to CONVOIA REVIEWS! These Terms and Conditions (“Terms”) govern your access to and use of the services, software, and websites (collectively, the “Service”) provided by realdresattle Marketing (“convoia Reviews,” “we,” “us,” or “our”).

Please read these Terms carefully. By creating an account or by accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1.1 Account Creation: You must be 18 years or older to use the Service. You agree to provide accurate, current, and complete information. You are responsible for safeguarding your password and for all activities under your account.

1.2 Account Responsibilities: You are solely responsible for your conduct, the content you submit, and your communications while using the Service. You agree not to share your credentials or allow others to access your account.

1.3 Team Members: If you add team members to your account, you are responsible for their compliance with these Terms.

2.1 Description: CONVOIA REVIEWS provides a platform for businesses to monitor, manage, analyze, and generate customer reviews from various third-party platforms.

2.2 Changes to the Service: We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

2.3 Third-Party Platforms: The Service interacts with third-party platforms (e.g., Google, Facebook). We are not responsible for the availability or accuracy of these platforms, or the content, products, or services on or available from them. You are responsible for complying with the terms of service of all third-party platforms.

You agree not to misuse the Service.

3.1 Use the Service for any illegal or unauthorized purpose.

3.2 Send unsolicited communications, promotions, advertising, or spam. You must comply with all applicable laws, including the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA), when sending review requests via email or SMS.

3.3 Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

3.4 Attempt to gain unauthorized access to the Service or any related systems or networks.

3.5 Upload or transmit any data, file, or link that contains or redirects to a virus, Trojan horse, worm, or any other harmful component.

4.1. Your Content: You retain all rights and ownership of the content you provide to the Service, including customer information, review responses, and campaign materials (“Your Content”).

4.2. License to Us: By using the Service, you grant us a worldwide, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing, maintaining, and improving the Service for you.

4.3. Data Privacy: Our use of your personal data and the personal data of your customers is governed by our Privacy Policy. You warrant that you have obtained all necessary consents from your customers to use their information (e.g., email address, phone number) for the purpose of sending review requests through the Service, in compliance with GDPR, CCPA, and other applicable data privacy laws.

5.1. Subscription Fees: You will be billed in advance on a recurring, periodic basis (such as monthly or annually), depending on the subscription plan you select.

5.2. Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account management page or by contacting our support team.

5.3. Price Changes: We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any price changes to give you an opportunity to terminate your subscription before such change becomes effective.

5.4. Cancellation: You may cancel your subscription at any time. You will retain access to the Service until the end of your paid billing period. No refunds will be issued for partial months of service.

5.5. Mobile app store subscriptions:Subscriptions purchased through the Apple App Store or Google Play are billed and renewed by Apple or Google. They automatically renew unless canceled at least 24 hours before the end of the current billing period. To cancel: iOS — Settings → Apple Account → Subscriptions; Android — Play Store → Payments & subscriptions. Deleting your Convoia account does not stop store billing.

5.6. Apple Standard EULA (iOS):If you download our app from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement.

6.1. Term: This Agreement will remain in effect until your subscription is terminated by either you or us.

6.2. Termination by Us: We may suspend or terminate your access to the Service with immediate effect if you are in breach of these Terms.

6.3. Effect of Termination: Upon termination, your right to use the Service will cease immediately. We may, but are not obligated to, delete Your Content from our systems.

6.4. Account deletion:You may delete your account in Profile → Password & security. See our Account deletion page for data removed, retention, and how to cancel store or web subscriptions.

7.1. Disclaimer of Warranties:The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied.

7.2. Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall CONVOIA REVIEWS, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

These Terms shall be governed and construed in accordance with the laws of Seattle, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration in Seattle.

9.1. Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
